Liberty Mutual Group Inc. and any affiliates, subsidiaries and parent companies, including those companies operating as Safeco Insurance (collectively “Liberty Mutual”), offers a program called Accident Assistance (the “Program”), that utilizes driving data to provide real time accident assistance. Your participation in the Program and use of our mobile application(s) (the “App”) which is required to enable the collection of data as part of the Program is expressly conditioned on your acceptance of these Terms and Conditions. Participation in the Program is voluntary and is not required to obtain an insurance policy. If you do not agree with these Terms and Conditions, then you should not participate in the Program.

By participating in the Program, you are expressly permitting Liberty Mutual to collect and transmit your data through the App. A list of the data elements collected can be viewed at https://www.libertymutual.com/telematics-data. This list will be updated as the data collected changes. Liberty Mutual may share certain data about you and your participation in the Program with other companies (collectively our “Service Providers”). Read below for more details about the information that we may share with our Service Providers.

Program Eligibility

Your eligibility to participate in the Program is contingent on you having an in-force, Program-eligible policy with Liberty Mutual, owning a compatible smartphone, providing your valid email address and/or other contact information approved by Liberty Mutual, and accepting these Terms and Conditions. You also agree that Liberty Mutual may contact you with program related information using your provided contact information.

Program Participation

To participate in the Program, you are required to properly download the App, complete the registration process, and keep the App enabled while driving. Data collection will begin on the date you download and register the App.

We may remove you from the Program if you cease data transmission. We reserve the right to bar you from future participation in the Program if we uncover evidence of tampering or disablement of the App.

In the event you are removed from the Program, you can request to be re-enrolled in the Program. Upon re-enrollment, you must satisfy data requirements.

If you would like to cease participating in the Program, Liberty Mutual Insurance customers should call 866-274-0892 and Safeco Insurance customers should contact the Safeco agent listed on their Declarations page.

You agree that any change in enrollment or participation in the Program will not retroactively apply to any data that was collected and/or transmitted prior to the effective date of any change in enrollment or participation.

Use of Data and Third Party Disclosures

We will not sell the data collected by participating in the Program. Where permitted by state regulators and applicable law, we may use the data as follows: for purposes of servicing your policy; providing services related to the Program; developing rate or premium information; developing other services and benefits to offer to you or other customers, underwriting, claims handling purposes, including but not limited to, reporting, investigating and adjusting claims, accident detection, or for research. We reserve the right to collect and use data as long as the App is in use and may retain the collected data as allowed by law. The data collected may be used as described above for current and future insurance policies issued by us or an affiliate, including automobile policies and other types of property and casualty insurance policies.

We may provide data to our Service Providers for the purposes described here. We may also share the data as permitted or required by law, such as pursuant to a subpoena, law enforcement or regulatory inquiry or some other duly authorized request.

Accident Assistance

The App may come equipped with our built-in Accident Assistance. Where permitted by state insurance and other laws, we may automatically turn on this feature for you. If so, the App will inform you that Accident Assistance is turned on. You can turn off the Accident Assistance feature in the settings within the App. If Accident Assistance is not automatically turned on, you may be able to enroll in Accident Assistance via the App. Accident Assistance is only intended to work when the user is located in the United States at the time a motor vehicle collision (“Event”) is detected. While accidents may be detected elsewhere, we are unable to offer assistance or dispatch emergency services outside the U.S.

When Accident Assistance is on, the App may detect if you are involved in a motor vehicle collision Event using the sensors in your mobile phone. If an Event is detected, the App will initiate automated call(s) and/or texts to your mobile device or send push notifications or in-app message(s) through the App, asking for your response to confirm the Event and determine whether you require an ambulance or tow service. If you affirmatively confirm the Event and request an ambulance or tow, Liberty Mutual will initiate the dispatch of these services on your behalf to your device location and will automatically open a claim under your policy. If you do not respond to Liberty Mutual's attempts to reach you to confirm the Event, we may, without your confirmation, initiate a 911 call for emergency assistance to your device location. If we determine you are not in need of emergency assistance, including if (where available) we detect you are driving the vehicle again within a pre-determined time period after the detected Event, we may discontinue any further outreach related to this Event.

The dispatching of emergency and/or tow services by you or us shall not be deemed a determination of coverage under your policy or guarantee payment for any filed claim.

Additionally, you expressly acknowledge that you, not Liberty Mutual or its vendors, licensors, and/or third party service providers, are the contracting authority for any dispatched emergency and/or towing services through the use of Accident Assistance. Therefore, you are solely liable for all costs, expenses and damages that arise from 911 emergency assistance or towing services received in connection with an Event and your use of Accident Assistance to the extent such costs, expenses and damages are not covered under your policy.
